For an Alabama workers’ compensation claim, there are time limitations, also known as the statute of limitations. All claims for compensation shall be barred unless a verified complaint is filed in the appropriate circuit court within two (2) years from the date of the accident. Where payments of compensation have been made, such complaint must be filed within two (2) years from the date of the last compensation payment. Otherwise, any action may be barred.
In other words, for most Alabama workers’ compensation claims, you have 2 years from the date of the accident to settle your claim or file a lawsuit.
