What’s the Most Important Thing in an Alabama Work Comp Claim?

When a person cannot go back to work or earn the same amount of money they were earning before being injured on the job, they might have a claim for vocational disability. In addition to the value of the injured worker’s permanent physician impairment rating, vocational disability can be used to determine the total value of some workers’ compensation claims. This situation can only be considered when the injured work has a body as a whole injury and not a scheduled member injury.

A scheduled member injury is typically when a finger, a hand, or even an arm are injured without interfering with the other body parts normal function or activity. Scheduled member injuries have specific assigned number of weeks value to that body part. For example, a hand is worth “x” # of weeks.

In comparison, body as whole injuries typically are backs, hips, shoulders and the head. These types of injuries necessarily involve multiple body parts and are not limited to one specific function. Also, the number of weeks in a claim for body as a whole injuries can be up to 300 weeks.

Pain can be considered when analyzing whether a scheduled injury should be viewed as a body as a whole injury. These arguments are usually hotly contested.

When vocational disability is at issue typically the injured worker is no longer eligible to work with the employer due to the permanent work restrictions ordered by the authorized treating physician. The employer cannot always accommodate the injured worker’s limitations so they might have the legal right to terminate the employment. As a result, the injured worker can pursue a claim for vocational disability if they cannot find suitable gainful employment elsewhere.

When this situation arises, in most instances, both parties (insurance adjuster / defense counsel and plaintiff’s counsel) will hire respective vocational experts to interview the injured worker as part of creating an opinion on vocational loss. This percentage of loss can be equated into a monetary value. Then it becomes a battle of the experts. The two sides will then either work towards a settlement or fight it out in court at trial.

Considerations When Your Child with Disabilities Turns 18

Under the workers’ compensation offset, created by Congress in 1965, the total amount from SSDI and workers’ comp cannot exceed 80 percent of the person’s “average current earning.”  This language has no effect on the amount of the worker’s compensation settlement itself; all it does is preserve Social Security benefits to the greatest extent possible. Inclusion of the language can reduce, or sometimes eliminate, the offset.

Phone scams happen all the time. Learn how to spot these scams to protect yourself. Knowledge is key!  

If there is a problem, the Social Security Administration (SSA) will mail you a letter. Generally, they will only contact you if you have requested a call or have ongoing business with them. 

The latest scam trick of using robocalls or live callers has increased. Callers pretend to be government employees and claim there is identity theft or another problem with one’s Social Security number (SSN), account, or benefits. Scammers may threaten arrest or other legal action, or may offer to increase benefits, protect assets, or resolve identity theft. They often demand payment via retail gift cards, wire transfers, pre-paid debit cards, internet currency, or mailing cash.

SSA employees will never threaten you for information or promise a benefit in exchange for personal information or money. However, they may call you in some situations, but will never threaten you, suspend your SSN or make financial demands of immediate payment from you 

Don’t be fooled! You should look out for:
A caller saying there is a problem with your SSN or account. Any call asking you to pay a fine or debt with retail gift cards, wire transfers, pre-paid debit cards, internet currency, or by mailing cash.
Scammers pretending they’re from us or another government agency. Caller ID or documents sent by email may look official but they are not.

Pursuant to Alabama law, subrogation is the right of a third party – usually a health insurance company – to recover money paid to or on behalf of an injured person from the amount the injured person receives from a responsible party.  This is based on the principle that an injured person should not recover twice for a single injury and that the insurer should be reimbursed for payments it made by the wrongdoer.  Most insurance contracts include claims for reimbursement. Subrogation claims are often found in personal injury claims and in workers’ compensation claims that are being disputed.

In 2013, Alabama enacted the Mandatory Liability Insurance Law to help define Alabama car insurance rules for all drivers. The law now requires Alabama drivers to carry auto insurance for their registered vehicles.  To fulfill Alabama car insurance laws, you must have liability insurance to help pay for any damages or injuries you may cause to others in a car accident. There are minimum coverage requirements and additional coverages that should be considered to protect yourself in case of an accident.

Why are Bankruptcy Filings are on the Rise?

Bankruptcy filings are up due to defaults on SBA loans where individuals have guaranteed debt for their companies that have gone out of business. Bankruptcy makes more sense than trying to settle with the SBA where there is a chance that you might incur a significant tax liability for discharge of indebtedness income.  Also, federal layoffs may result in more bankruptcy filings in the future as well.

If you fail to disclose your worker's comp claim in your bankruptcy case, your claim may be denied.  The insurance company or your employer can raise a defense that will bar your claim. What happens if you don’t tell your bankruptcy lawyer about your W/C claim?

If you are considering filing for bankruptcy and have a worker’s comp case, be sure to tell your bankruptcy lawyer about your case and disclose it as an asset on your schedules.
